The Female Genital Mutilation Act 2003 (Commencement) Order 2004

This Order brings the Female Genital Mutilation Act 2003 into force on 3rd March 2004. This is not part of the syllabus, except so far as it illustrates cultural mores and morality issues in module 6.

  1. Would this act be relevant to mention in an exam question regarding Offences Against the Person-as it is a development in the law

  2. Yes. The detail is rather unsavoury however, much of the mutilation would amount to wounding, GBH or even GBH with intent. You may ask yourself why we need such an Act if we have adequate protection under the OAP 1861.
    No. It is not part of the syllabus and you are not expected to know about it. I hope it never is part of the syllabus because I would find considerable embarrassment explaining the detail to 16 year old.
    Yes. It is a good example of how the law develops to take account of activity that was “never anticipated or prepared for” (Lord Reid’s words, I think in Shaw or Knuller – I can’t quite remember).
