Jackson opposes ministerial plans on court costs

Lord Justice Jackson produced the first report on the costs in civil litigation on Friday.

The second and possibly the final phase of the review, is expected in December.

Ministers are hoping to make civil litigation self-funding but Jackson says this is wrong in principle.

  1. Although there may be legitimate objections to making civil litigation “self-funding” in terms of court fees, this amounts to a very small proportion of general litigation legal costs. It has no real impact on the willingness of people to bring claims.
