{"id":11,"date":"2003-08-15T18:56:47","date_gmt":"2003-08-15T18:56:47","guid":{"rendered":""},"modified":"2003-08-15T18:56:47","modified_gmt":"2003-08-15T18:56:47","slug":"law-justice-miscarriages-cooper-mcmahon","status":"publish","type":"post","link":"https:\/\/www.sixthform.info\/lawblog\/?p=11","title":{"rendered":"Law &#038; Justice &#8211; Miscarriages &#8211; Cooper &#038; McMahon"},"content":{"rendered":"<p>The significance of this case is that the miscarriage of justice survived for <b>over 30 years<\/b>.<br \/>\n<b>1970 <\/b>Patrick Colin Murphy, Michael Graham McMahon and David Cooper were convicted of the murder of Reginald Stevens at Luton during a bungled post office robbery in 1969.<\/p>\n<p><b>Sequence of appeals:<\/b><br \/>\n<b>1971 <\/b>appeal dismissed by C of A.<br \/>\n<b>1973 <\/b>the Home Secretary referred the case of Murphy to the C of A who allowed his appeal.<br \/>\n<b>1975 <\/b>the Home Secretary referred the cases of Cooper and McMahon, but their appeals were dismissed.<br \/>\n<b>1976 <\/b>a second reference was again dismissed.<br \/>\n<b>1978 <\/b>the C of A declined to receive fresh evidence tendered by McMahon following a further reference by the Home Secretary.<br \/>\n<b>1980 <\/b>Cooper and McMahon were released from prison by order of the Home Secretary, because of the &#8220;widely felt sense of unease&#8221; about the safety of their convictions.<br \/>\n<b>1995 <\/b>Cooper died.<br \/>\n<b>1999 <\/b>McMahon died.<br \/>\n<b>2001 <\/b>the Criminal Cases Review Commission referred their cases to the C of A.<br \/>\n<b>31st July 2003<\/b>, <b>their appeals were allowed<\/b>.
