This new order is a product of the<strong> Criminal Justice and Immigration Act 2008<\/strong>.\u00a0 The existing requirements, such as Attendance Centre Orders, and fines still exist, but now as part of the generic order.<\/p>\n<p>Implementation has been staggered and so not all provisions start at the same time.<strong><\/strong><\/p>\n<p><strong>Purposes of sentencing<\/strong><br \/>\nWhen sentencing a young offender under the age of 18 the Court must have regard to the following:<br \/>\n\u2022\tthe principal aim of the youth justice system (to prevent offending and reoffending)<br \/>\n\u2022\tthe welfare of the offender<br \/>\n\u2022\tthe purposes of sentencing, which are<\/p>\n<p style=\"padding-left: 30px;\">o\tpunishment<br \/>\no\treform and rehabilitation<br \/>\no\tprotection of the public<br \/>\no\treparation to persons affected by offences.<\/p>\n<p>Definitive guidelines (overarching principles) takes effect in relation to youth sentencing and the &#8220;scaled approach&#8221; will be implemented by all YOTs teams.<\/p>\n<p>There have been many changes in youth sentencing over recent years, but this is the most significant.<\/p>\n<p>The Home Office have produces a useful diagram to introduce this topic, it is <a href=\"http:\/\/www.yjb.gov.uk\/NR\/rdonlyres\/0ED1E679-2D09-4269-9E80-AA9DC768C802\/0\/TheCriminalJusticeandImmigrationBillYouthSentenceStructure.pdf\">here<\/a>.<\/p>\n<p>All the changes in detail can be read <a href=\"http:\/\/www.yjb.gov.uk\/en-gb\/practitioners\/CourtsAndOrders\/CriminalJusticeandImmigrationAct\/\">here<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Youth offending &#8211; changes in sentencing On 30th November 2009, almost all youth sentences are replaced by a generic \u201cYouth Rehabilitation Order\u201d.
