{"id":1255,"date":"2009-11-21T06:48:52","date_gmt":"2009-11-21T06:48:52","guid":{"rendered":"http:\/\/www.sixthform.info\/lawblog\/?p=1255"},"modified":"2009-11-21T06:48:52","modified_gmt":"2009-11-21T06:48:52","slug":"new-bar-working-practices","status":"publish","type":"post","link":"https:\/\/www.sixthform.info\/lawblog\/?p=1255","title":{"rendered":"New bar working practices"},"content":{"rendered":"<div class=\"img alignleft size-thumbnail wp-image-1119\" style=\"width:150px;\">\r\n\t<img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.sixthform.info\/lawblog\/wp-content\/uploads\/2009\/08\/lsn142-150x150.jpg\" alt=\"Barristers to change working practices\" width=\"150\" height=\"150\" \/>\r\n\t<div>Barristers to change working practices<\/div>\r\n<\/div>The Bar Standards Board (BSB), has proposed changes in barristers\u2019 working practices by giving approval for barristers to supply legal services through the legal structures known as Legal Disciplinary Practices (LDPs).<\/p>\n<p>The proposals would allow barristers to form partnerships and act in other capacities.<\/p>\n<p>Barristers should be permitted to become managers of LDPs, regulated by the SRA without having to re-qualify as solicitors.<br \/>\nBarristers should be permitted to practice in more than one capacity at the same time e.g. as both managers of LDPs and as independent practitioners.<br \/>\nBarristers should be permitted in principle to form barrister-only partnerships (BoPs).<br \/>\nThe cab-rank rule will apply to barrister only partnerships, as well as the self-employed Bar.<\/p>\n<p>The code changes will have to be referred to the Ministry of Justice or the Legal Services Board for approval.<\/p>\n<p>Barrister-only practices will be able to better share risk; for example Conditional Fee Agreements (CFAs \u2013 no win no fee) where as now individual practitioners feel unable to bear the risk of doing so.<\/p>\n<p>In deciding to apply the cab-rank rule to advocates in barrister-only entities and to seek to apply that rule to all advocates, the Board  wishes to preserve a unique attribute of the Bar, in the public interest, one the Lord Chief Justice has described as \u2018essential to the administration of justice\u2019.<\/p>\n<p>BSB Press release <a href=\"http:\/\/www.barstandardsboard.org.uk\/news\/press\/774.html\">here<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Barristers to change working practices The Bar Standards Board (BSB), has proposed changes in barristers\u2019 working practices by giving approval for barristers to supply legal services through the legal structures known as Legal Disciplinary Practices (LDPs).
