{"id":698,"date":"2008-12-21T10:43:35","date_gmt":"2008-12-21T09:43:35","guid":{"rendered":"http:\/\/www.sixthform.info\/lawblog\/?p=698"},"modified":"2009-01-01T09:42:49","modified_gmt":"2009-01-01T09:42:49","slug":"the-police-and-criminal-evidence-act-1984-codes-of-practice-revisions-to-code-a-no-2-order-2008","status":"publish","type":"post","link":"https:\/\/www.sixthform.info\/lawblog\/?p=698","title":{"rendered":"The Police and Criminal Evidence Act 1984 (Codes of Practice) (Revisions to Code A) (No. 2) Order 2008"},"content":{"rendered":"<p>This Order brings into operation on 1 January 2009 the revision of paragraph 4 of the Police and Criminal Evidence Act 1984 Code of Practice.<\/p>\n<p>It regulates the exercise by police officers of statutory powers of stop and search and police officers and police staff of requiremen<div class=\"img alignleft size-thumbnail wp-image-704\" style=\"width:150px;\">\r\n\t<img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.sixthform.info\/lawblog\/wp-content\/uploads\/2008\/12\/pace_codes1-150x150.jpg\" alt=\"pace_codes1\" width=\"150\" height=\"150\" \/>\r\n\t<div>pace_codes1<\/div>\r\n<\/div>ts to record public encounters (\u201cPACE Code A\u201d).<\/p>\n<p>The Order also brings into operation the clarification in paragraphs 2.2 and 2.3 of Code A regarding <span style=\"color: #ff0000;\"><em><strong>reasonable suspicion <\/strong><\/em><\/span><span style=\"color: #ff0000;\"><em><strong>not being based on single factors alone<\/strong><\/em>.<\/span><\/p>\n<p>Paragraphs 4.10A and 4.10B of PACE Code A are also amended to<em><strong> <span style=\"color: #ff0000;\">clarify the position on providing receipts for stops and searches.<\/span><\/strong><\/em><\/p>\n<p>The revision of paragraph 4 of PACE Code A (recording requirements including recording of encounters not governed by statutory powers), together with the consequential deletion of Annexes D and E will mean that<em><strong> <span style=\"color: #ff0000;\">c<\/span><span style=\"color: #ff0000;\"><span style=\"color: #ff0000;\">o<\/span>nstables will no longer be required to record all encounters not governed by statutory powers<\/span><\/strong><\/em><span style=\"color: #ff0000;\">.<\/span><\/p>\n<p>The constables will only need to record information on the ethnicity of a person whois the subject of such an encounter.
