{"id":785,"date":"2009-01-20T09:08:21","date_gmt":"2009-01-20T09:08:21","guid":{"rendered":"http:\/\/www.sixthform.info\/lawblog\/?p=785"},"modified":"2009-01-20T09:09:44","modified_gmt":"2009-01-20T09:09:44","slug":"criminal-justice-and-immigration-act-2008-now-in-force","status":"publish","type":"post","link":"https:\/\/www.sixthform.info\/lawblog\/?p=785","title":{"rendered":"Criminal Justice and Immigration Act 2008 now in force"},"content":{"rendered":"<p>The following are provisions of the new act:-<\/p>\n<div class=\"img alignleft size-thumbnail wp-image-431\" style=\"width:84px;\">\r\n\t<img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.sixthform.info\/lawblog\/wp-content\/uploads\/2007\/07\/prison.thumbnail.jpg\" alt=\"Prison\" width=\"84\" height=\"128\" \/>\r\n\t<div>Prison<\/div>\r\n<\/div>\u2022 Creates an offence of inciting hatred on the grounds of sexual orientation.<br \/>\n\u2022 Bans possession of extreme pornographic images.<br \/>\n\u2022 Clarifies the law on self-defence, articulating the state&#8217;s responsibility to stand by those acting in good faith when using force in self-defence.<br \/>\n\u2022 Introduces new civil penalties for serious breaches of data protection principles and makes unlawfully obtaining personal data a custodial offence punishable by up to two years in prison.<br \/>\n\u2022 Abolishes the common law offences of blasphemy and blasphemous libel.<br \/>\n\u2022 Bans strike action by prison officers.<br \/>\n\u2022 Grants courts the power to make dangerous offenders given a discretionary life sentence serve a higher proportion of their tariff before being eligible for parole.<br \/>\n\u2022 Introduces the premises closure order which allows the police and local authorities to apply to magistrates&#8217; courts to close privately owned, rented, commercial and local authority premises at the centre of serious and persistent disorder or nuisance.<br \/>\n\u2022 Creates violent offender orders: civil preventative orders that allow courts to impose post-sentence restrictions on those convicted of violent offences.<br \/>\n\u2022 Clarifies the sentencing procedures for youth offenders; creates the youth conditional caution and the youth rehabilitation order, a generic community sentence.<br \/>\n\u2022 Introduces a special immigration status for those believed to have been involved in terrorism and other serious crimes. Recipients have no formal leave to enter or remain in Britain, and the home secretary can impose conditions on their residence and employment and require them to wear an electronic tag.
